A new approach to special and differential treatment, Washington, D.C. : International Food & Agricultural Trade Policy Council, 2004, 12 p. The original purpose of Special and Differential Treatment (S&D) was to level the playing field and give
developing countries more time to adapt to international competition. Currently, S&D provides few
benefits to developing countries, and serves as a rationale for limited concessions on the part of
developed countries. The IPC believes that there are positive measures that can make S&D more
precise, effective, and operational as called for in the Doha Declaration. This position paper advocates differentiating developing
countries into three categories: Least Developed, Lower Middle Income Developing and Upper Middle
Income Developing Countries for international trade. Each group of countries should undertake
commitments in market access, domestic support and export competitition according to their capability.

SYKES, "Chile : Price Band System and Safeguard Measures Relating to Certain Agricultural Products", in : World Trade Review, 3 (2004), no. 3, pp. 507-528 This paper addresses the dispute brought to the World Trade Organization (WTO) by Argentina concerning certain Chilean measures affecting the importation of wheat, wheat flour, oil seeds, edible vegetable oils and sugar. The complaint by Argentina challenged two types of policies – a ‘price band system’ that was applicable to four of those product categories, and safeguard measures that were applicable to three of them. The WTO panel ruled in favor of Argentina on both sets of measures. It found that the price band system violated Article IV of the Agriculture Agreement and Article II of GATT 1994. The safeguard measures, according to the panel, violated various provisions of the Safeguards Agreement, as well as Article XIX of GATT 1994. Chile elected not to appeal the panel ruling regarding the safeguard measures, but did appeal the adverse finding as to the price band system. This “endowed production capacity” results not only from an advantage in ecological resources but from investments that have exploited these natural advantages. The structural characteristics of aggregate agriculture--inelastic supply; lack of alternate uses for cropland, especially in regions of extensive agriculture; and inelastic demand--limit the ability of free markets and free trade to influence the utilization of the production capacity in agriculture and produce an outcome in favor of most countries, especially developing countries. A case is also made that the distribution of the benefits from establishing free trade in agricultural products is significantly limited by the production capacity already in existence. This has contributed to fixing trade flows in favor of the small number of countries that control the majority of this production capacity. | |

As far back as Ricardo's principle of comparative advantage - from which all trade liberalisation theory ultimately derives - it has been customary to treat agriculture as the general exception to trade rules. To this day, nations protect their agricultural trade in a variety of ways: through the limited quantitative restrictions and export quotas permitted under prevailing trade rules, through country-specific derogation in the form of waivers, or even through blatant violations of the General Agreement on Tariffs and Trade (GATT). In fact, despite the general dramatic decline in tariffs in recent decades, the level of effective protection against the flow of agricultural trade has been steadily rising, almost entirely at the behest of developed countries and to the detriment of developing countries. This book analyses the current realities and future prospects for global trade in agricultural products. It seeks to explain the real or apparent rationale behind the virtual exemption of agricultural trade from the operation of the law governing international trade in general, focusing on the GATT/WTO system but examining a variety of nation-source policy reasons that generate this crucial counter-current to the general sweep of trade liberalization. |
