Food product attributes related to geographical origins are a topical issue in global food trade. The provision of geographical labeling may occur through geographical indications under the mandated trade rules of the TRIPS Agreement, through trademarks, or through country-of-origin labeling. The overall effect of the expansion of geographical labeling on developing countries depends on a complex mix of market opportunities that may yield substantial benefits as well as implementation costs. Increasingly, the analysis of this overall effect will need to evaluate the joint impacts of different forms of geographical labeling on the market position of developing countries.

Indian patent law recently landed itself in the eye of a TRIPS storm on account of the rejection of a patent application covering Novartis’ famed anticancer drug, Glivec. The rejection stemmed, inter alia, from a unique section in the Indian patent regime (section 3(d)) that seeks to prevent “ever-greening” by prohibiting the patenting of new forms of existing pharmaceutical substances that do not demonstrate significantly enhanced “efficacy.” Not only did Novartis appeal the patent office decision, but in a rather controversial move, it challenged the TRIPS compatibility and constitutionality of section 3(d). This paper not only offers suggestions on how these creases may be ironed out, but also goes on to suggest an amendment to section 3(d). While some of the suggestions in the paper are immediately implementable, other issues will necessarily involve a more detailed empirical/policy investigation. This paper highlights some of the factors that one might consider whilst undertaking such empirical investigation, a task which is likely to go to the very heart of the age-old debate about what constitutes optimal intellectual property norms for developing countries.

his article analyzes rule making in the WTO with special reference to Article 6 of the TRIPS Agreement. Two competing approaches to parallel imports characterized the Uruguay Round negotiations: to prohibit parallel imports or to permit them. The contracting parties were adamant in holding to their competing positions; therefore, the negotiators designed Article 6 of the TRIPS Agreement with an open texture so that both of these competing approaches could be legitimized. Consequently, the nature of Article 6 of the TRIPS Agreement is extremely complex, leading to disharmonious legal regimes and practices at the domestic level. Moreover, the wording of Article 6 has resulted in a disguised form of protection of embedded producer interests at the cost of consumer interests. Against this background, this article argues for the need to establish the true nature of Article 6 of the TRIPS Agreement, that is, as embodying international exhaustion rules in light of the Paris and Berne conventions.

As of January 1, 2005, all developing country members of the WTO are required to implement the WTO Agreement on Trade Related Intellectual Property Rights (TRIPS). The authors analyze the issue of access to patented medicine to treat global and neglected diseases in developing countries in the context of WTO law. They present legal and economic arguments that support balancing the rights of producers and users on a market-by-market basis and argue against taking a uniform approach globally. The authors conclude that global patent rights are not necessary to provide research incentives to pharmaceutical firms to invent treatments for global and neglected diseases. The authors develop an analytical framework for assessing special and differential treatment of developing countries in WTO law and apply this framework to TRIPS. They then propose a formula for assessing the correct balance between the rights of producers and users on a market-by-market basis.

Geographical indications emerged on the international scene at the centre of three highly debated subjects: intellectual property, international trade and agricultural policy. This article discusses the use of geographical indications in the protection of traditional knowledge-based agricultural products in the international intellectual property framework, and assesses the challenges and opportunities geographical indications present with respect to efforts to cater to the needs of indigenous people and local communities. The discussion begins with a succinct overview of the definitional aspects of geographical indications, traditional knowledge and traditional knowledge-based agricultural products. In an attempt to locate the issue of geographical indications in the current intellectual property landscape, the article examines their regulation in international and national legal frameworks, and critically appraises the attendant controversies in international negotiations. The article then broaches issues to do with the link between geographical indications and traditional knowledge, and examines the cultural, economic and environmental issues in policy debates surrounding the applicability of geographical indications to traditional knowledge-based agricultural products.
