Following an analysis of the economic effects of services liberalization, 19 chapters on individual service sectors consider the issues which WTO Members need to consider when framing their negotiating positions and objectives for the new round and preparing their industries for a more open trading environment. Many of the papers also identify prevalent forms of trade restriction or discrimination and suggest areas for further work. In addition, the work includes a detailed description of the structure of services commitments as submitted by WTO Members with respect to the four modes of supply which constitute the definition of trade in services under the GATS. The contributions have been provided by experts of the Trade in Services Division of the WTO Secretariat. |

These impacts, estimated on the basis of market, demographic, and policy variables, establish a baseline from which the achievements of future trade rounds, including the Doha Round, could be compared. In a departure from previous literature in this area, this article draws on documents appended or pertaining to the General Agreement on Trade in Services (GATS) to identify barriers to trade in voice telephone services, and to estimate quantity impacts on this basis. The article finds that market access and national treatment commitments scheduled by WTO members under the GATS, when complemented by commitments to pro-competitive regulatory disciplines, may be formulated into meaningful policy variables. These policy variables are found to be statistically significant in explaining market penetration in voice telephone services, as are variables for income and private sector ownership. | |

BURRI-NENOVA, MIRA, "Trade and Culture : Making the WTO Legal Framework Conducive to Cultural Considerations", in : Manchester Journal of International Economic Law, 5 (2008), no. 3, pp. 2-38 The area of trade and culture reveals extreme fragmentation. Instead of mitigating this state, the UNESCO Convention on the Protection and Promotion of the Diversity of Cultural Expressions, which entered into force in March 2007, makes the disconnect between regulatory issues of trade and culture even more profound. The present article critiques this politically driven structural disconnection and exposes the Convention's failing potential to provide feasible solutions accommodating cultural policy objectives in a least trade- and competition-distortive manner. In a second analytical strand, the article explores the changed conditions for creativity, as well as for production, distribution and consumption of cultural content, in the now pervasive digital networked environment. Under the conditions of the latter, any type of trade restriction upon the flow of cultural goods and services may be deemed dubious and could indeed be detrimental to the goal of cultural diversity. Paradoxical as it may sound, it could be that the WTO offers the better solutions. In this context, the article reveals a number of 'neutral' paths towards making the WTO framework more culture-conducive.

CODD, KATHRYN B., "Betting on the wrong horse : the detrimental effect of noncompliance in the Internet gambling dispute on the General Agreement on Trade in Services (GATS)", in : William and Mary Law Review, 49 (2007), pp. 941-971 As part of a crackdown the US federal government and the states started to pass and enforce regulations prohibiting Internet gambling, resulting in the arrest and conviction of executives of foreign gambling operations who dared to set foot on US soil. One small country, Antigua and Barbuda, attempted to fight back against what it perceived as unfair discrimination against one of its primary sources of income. Antigua brought a complaint against the US to the WTO, alleging violations of US obligations under the GATS. The WTO found the United States to be in violation of a specific provision of GATS and ordered the United States to bring federal law into conformity with its GATS obligations. Part I provides background on the Internet gambling industry, both in Antigua and worldwide. Part II discusses Antigua's complaint against the United States and the WTO decision in the gambling dispute and sets forth the basic GATS and DSU provisions governing such a dispute. Part III considers the benefits of maintaining a strong mechanism for resolving service trade disputes under GATS and addresses specific compliance issues under the DSU generally. Part IV analyzes previous compliance issues under other WTO agreements and explains why noncompliance in the gambling dispute, in particular, is more likely to damage the pertinent multilateral trade agreement, GATS. Finally, this note argues for the United States' quick adoption of the WTO recommendations in the gambling dispute to preserve the legitimacy of GATS. | |

GARI, GABRIEL, "Legal instruments for the liberalization of trade in services at the sub-regional level : the MERCOSUR case", in : Penn State International Law Review, 25 (2007), pp. 659-705 With the recent entry into force of the Protocol of Montevideo on Trade in Services, the MERCOSUR legal system includes three main instruments for the liberalization of trade in services: a number of general obligations and disciplines that prescribe minimum standards of treatment for foreign services and service providers, a Program of Liberalization based on the negotiation of specific concessions on Market Access and National Treatment and a rule-making process for the adoption of secondary legislation on specific service sectors. This article assesses the impact these instruments may have on the liberalization of trade in services and suggests ways to enhance their efficacy and to foster Members' compliance with MERCOSUR disciplines on services within the limits of MERCOSUR's strictly intergovernmental approach to integration. This article contends that the success of any strategy for the liberalization of trade in services ultimately will be conditioned to the improvement of the transparency, economic efficiency, impartiality and due process of domestic regulatory practices. | |

Over the past two decades, international trade in services has grown faster than world merchandize trade, which in turn has grown faster than world output. A combination of policy liberalization and technological progress has facilitated trade in many previously untradable services. However, very little progress has been made towards new policy liberalization in the ongoing Doha Development Round. This article discusses trade in services in five sections. Following a short introduction, Section I presents data on the past growth of services trade flows and makes rough projections of future expansion. The second and third sections summarize the achievements of the WTO in the service field, both as a negotiating forum and a dispute settlement system. The third section also emphasizes how FTAs are now playing the leading role in services liberalization. The fourth section critiques the absence of progress in the Doha Round and the fifth section examines the hot issue of services outsourcing. The concluding section offers policy recommendations for containing a possible protectionist backlash and promoting new liberalization. | |
